5.1 Amendments to the Constitution and Bylaws
Amendments may be proposed in writing by any member of the Union to the Governing Board through his or her departmental delegate. The Governing Board shall accept all proposals submitted and must vote on each proposal. If adopted by the Governing Board, the amendments must be submitted in writing to the general membership for ratification by a majority of members voting in a secret ballot (Article III ELECTIONS). If approved by a majority of members voting in secret ballot, the amendment becomes effective immediately upon certification by the Election Commissioner. No provisions of this Constitution can be abridged or otherwise amended as a result of contract negotiations with the employer.
Each new member shall be provided with an up-to-date copy of this Constitution.
5.1.1 Amendment By Referendum
If the Governing Board receives a petition signed by 10 percent of the members who seek a Constitutional amendment, the petition language shall be placed on the ballot at the next general election (Article III ELECTIONS).
